We provide transparent transport of Ethernet frames between the demarcation points identified in the Service Order, at the port speed, committed bandwidth and service type (for example point-to-point private line or virtual circuit on shared infrastructure) stated there. The Service does not include Internet access, IP addressing or routing unless the Service Order says otherwise.
The interface type, framing, supported maximum transmission unit, VLAN handling (including any tag translation or trunking) and, where applicable, class-of-service markings for each circuit are stated in the Service Order. Traffic exceeding the committed bandwidth or violating the agreed frame parameters may be shaped or discarded. You are responsible for the configuration and operation of your equipment on your side of each demarcation point.
Where delivering a circuit requires construction — new fibre, building entrance, conduit or make-ready work — the Service Order states the construction charges or the assumptions on which the quoted charges rest. Quotes issued before a site survey are estimates; if survey or permitting reveals materially higher costs, we will present the revised cost for your approval before proceeding, and either party may cancel the affected circuit without liability (other than costs already incurred with your approval) if agreement is not reached. Rights-of-way, landlord consents and in-building permissions at your and your End Users' sites are your responsibility; ours are our responsibility on our network.
We will notify you when a circuit is installed and tested. The circuit is accepted, and billing starts, on the earlier of: your written acceptance; your use of the circuit for live traffic; or five (5) Business Days after our notice, unless within that period you report a material fault that our testing confirms, in which case acceptance and billing are deferred until the fault is corrected.
Availability and repair commitments, and the credits that apply when they are missed, are as stated in the Service Order, and are your sole remedy for the failures they measure. We perform planned maintenance in announced maintenance windows on reasonable advance notice; emergency maintenance may be performed on shorter notice where required to protect the network. Protected and diverse configurations, where ordered, are described in the Service Order; unless the Service Order states diversity or protection, a circuit is unprotected.
You may use transport circuits to deliver your own services to End Users. Where a circuit terminates at an End User premises, sections 2 (ordering and appointments) and 8 (equipment at End User premises) of Wholesale Schedule 1 apply to that termination, whether or not Schedule 1 Services are otherwise ordered.
